Information We Collect

We only collect personal information that you voluntarily provide to us or that is collected automatically as you use our site. The types of personal data we may collect include:

  • Contact Identifiers: Name, email address, phone number, company name (if you represent a business), and mailing/shipping address. We collect these when you fill out forms (e.g. requesting calibration services, purchasing products, or contacting us). This information allows us to identify and communicate with you and to fulfill your orders or service requests.
  • Geolocation Data: General location information such as your city, state, or region, which may be derived from your IP address or you may provide it as part of an address. We do not collect precise GPS coordinates, only general location data used for service availability and analytics purposes.
  • Transactional Information: If you purchase products or services from us, we (or our payment processor) collect information necessary to process the transaction. This includes payment information (such as credit card number) and billing/shipping address, as well as details of the products or calibration services requested. Payment card data is handled via secure, PCI-compliant payment processors, and we do not store your full credit card number on our servers.
  • Communications: The content of your communications with us, such as details you provide in emails, phone calls, or form submissions, and any preferences (e.g. your interest in receiving newsletters or SMS updates). We keep this information to respond to your inquiries and improve our customer service.
  • Usage and Device Data: When you visit our website, certain information is collected automatically by cookies and similar tracking technologies. This may include your IP address, browser type, device identifiers, pages viewed, how you arrived at our site, and times/dates of visits.   • Communication: We use your contact information (email, phone number) to communicate with you about services or purchases – including sending service reminders, status updates, invoices/receipts, and responding to inquiries or support requests. With your consent, we may also send you newsletters, promotional offers, or other marketing communications about new products or services that might interest you (see Marketing Communications below).
  • Analytics and User Experience: Information about how users navigate and use our website is analyzed (often in aggregate) to understand which pages or services are most popular and to detect usage trends. Cookies and Analytics

Cookies: Like most websites, we use “cookies” and similar tracking technologies (such as web beacons or pixels) on our site. Cookies are small text files placed on your device to store data that can be recalled by the web server in the domain that set the cookie. We use cookies to enable site functionality (like remembering your preferences) and to personalize your experience. You can set your browser to refuse cookies or alert you when cookies are being sent.

Analytics: We use third-party analytics services, specifically Google Analytics, to collect and analyze usage information. Google Analytics may set cookies or collect device identifiers to gather information about site traffic and user interactions in order to help us understand how visitors use our site. This data (such as pages visited, time spent, referring site, and general location of visitors) allows us to gauge the effectiveness of our site content and marketing campaigns. Google Analytics provides reports that help us improve our website and services. The information collected by Google Analytics is mostly aggregated and not personal to you; however, Google may receive some data like your IP address which could be considered personal information. If you wish to opt out of Google Analytics tracking, Google provides a browser add-on tool for this purpose. Additionally, certain browser settings or extensions can be used to block analytics scripts.

Other Tracking: Our email newsletters (if you subscribe) may contain a “web beacon” or tracking pixel that informs us whether you open the email or click on links, which helps us gauge interest and improve communications. You can disable image loading in your email client if you prefer not to allow this tracking. We do not use third-party advertising cookies or trackers for targeted advertising without your consent, and at present we do not conduct behavioral advertising on our site.

How We Share Your Information

  • Service Providers and Partners: We share data with trusted third-party service providers who perform functions on our behalf and under our instructions. This includes, for example:
    • Email and Marketing Services: If you opt in to our email newsletter or other marketing communications, we use Constant Contact (an email marketing platform) to manage our email list and send messages. We provide your name and email to Constant Contact solely to send you our communications; they act as our data processor and may not use your information for their own purposes.
    • Communications & SMS: If you request text message updates or communicate with us via SMS, we may use a service provider (such as RingCentral) to send those messages. Your phone number is shared with that provider only to facilitate the texts on our behalf, not for independent use. We do not share any mobile opt-in information with outside parties for marketing (see SMS/Text Messages below for more details)
    • Analytics Providers: As noted, we use Google Analytics to collect site usage data. Google acts as a service provider for analytics, meaning the data it collects on our behalf is governed by our instructions and is not used to identify you for other Google services.
    • Payment Processors: When you make a purchase, your payment details are handled by third-party payment processors (such as credit card companies or merchant services) that specialize in secure payment processing. They are authorized to use your information only as needed to process payments and comply with legal requirements (like fraud prevention).
    • Shipping Partners: If we ship products to you, we share the necessary shipping information (name and address, and possibly phone/email for delivery updates) with carriers or logistics companies to deliver your orders.
    • Other Vendors: We may also use other vendors for functions like web hosting, data storage, or customer relationship management. These vendors may have incidental access to personal data in the course of providing their services, but they are contractually bound to safeguard your information and use it only for our specified purposes.

All our service providers and partners are required to protect your data and are prohibited from using your personal information for any purpose other than to provide services to us, in line with this Privacy Policy.

  • Business Transfers: If Thermo-Temp is involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of assets, or transition of service to another provider, your information may be transferred as part of that transaction as permitted by law. In such an event, we would ensure the successor entity honors the commitments we have made in this Privacy Policy regarding your personal data.
  • Legal Compliance and Protection: We may disclose personal information if we believe in good faith that such action is necessary to comply with applicable law, regulation, legal process, or government request (for example, in response to a court order or subpoena). We may also disclose data to enforce our agreements or policies, and to protect the rights, property, or safety of Thermo-Temp, our customers, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

Aside from the above, we will not share your personal information with third parties unless we have your explicit consent to do so. Importantly, no mobile opt-in or text message consent will be shared with third parties or affiliates – if you’ve entrusted us with permission to text or call you, that consent information stays with us and is not passed around or sold.

Marketing Communications and Opt-In Consent

We offer our clients the opportunity to receive updates, promotions, or other information via email and/or SMS text messages. We will only send you marketing communications if you have opted in to receive them. Here is how we handle consent and communications:

  • Email Newsletters: You may choose to subscribe to our newsletter or promotional emails by providing your email address and affirmatively opting in (for example, by checking a signup box on our contact or checkout form). Our email sign-up clearly describes what you are consenting to (such as receiving periodic news, product updates, and offers). You can unsubscribe at any time by clicking the “Unsubscribe” link in any marketing email or by contacting us, and we will promptly remove you from our mailing list. We use Constant Contact to manage our email communications, and each email footer contains a link to this Privacy Policy and an easy unsubscribe option, as required by law (e.g., CAN-SPAM Act). We do not share your email address with third parties for their own marketing.
  • SMS/Text Messages: If you expressly opt in to receive SMS text alerts or communications from us (for example, by checking the box on our contact form consenting to SMS updates), we will send you text messages regarding your order or our services or promotions. We obtain your prior express consent for SMS messaging in compliance with laws like the Telephone Consumer Protection Act (TCPA). When you provide your mobile number for SMS, you will see a clear consent message (e.g., “I agree to receive text messages from Thermo-Temp”) alongside the sign-up checkbox. We use your mobile number only for the specific text messaging program you opted into (such as appointment reminders or special offers). No mobile opt-in or text message consent will be shared with third parties or affiliates, aside from Ringcentral, the platform we use to manage our text messaging – we keep your mobile number and consent strictly confidential. RingCentral will not sell or share your number to any other parties. Message frequency may vary, but you will only receive a reasonable number of texts as described when you signed up (for example, a few messages per month). Standard message and data rates may apply to any texts we send, as imposed by your mobile carrier. You can opt out of SMS messages at any time: simply reply “STOP” to any of our texts, and we will stop texting you (you may receive one final confirmation message). If you need assistance or have questions, you can reply “HELP” or contact us directly. Whether you opt in or opt out of marketing texts will not affect your access to our products or services; we will honor your choice, and opting out of texts will not be held against you in any way.
  • No Third-Party Marketing: We do not sell or disclose our customers’ contact information to third-party marketers. All promotional communications will come directly from Thermo-Temp. You will never receive marketing emails or texts from others as a result of trusting us with your information (unless you separately give consent to another organization).
  • Opt-In via Checkboxes: All marketing opt-ins (email or SMS) on our website use unchecked checkboxes by default, which require you to actively check them to consent. We record and maintain a record of your consent choices. This is to ensure compliance with GDPR and other laws requiring clear, affirmative consent for communications. If you have previously opted in and wish to withdraw consent, simply use the unsubscribe/STOP methods described or contact us to update your preferences.

Please note that even if you opt out of marketing messages, we may still send you transactional or service-related communications as needed (e.g., appointment confirmations, invoices, or customer support responses), which are not promotional in nature.

Your Privacy Rights

Depending on your jurisdiction (for example, if you are a resident of California or Texas, or a resident of the European Union), you may have certain rights regarding your personal information. Thermo-Temp is committed to honoring these rights and providing you with control over your data.

Rights for California and Other U.S. State Residents

If you are a resident of California, you are protected by the California Consumer Privacy Act (CCPA) (as amended by the CPRA), and if you are a resident of Texas, you are protected by the Texas Data Privacy and Security Act (TDPSA), effective July 1, 2024. Other states may have similar laws. Subject to certain limitations, these laws provide you with the following rights:

  • Right to Know/Access: You have the right to request that we disclose what personal information we have collected about you in the past 12 months, including the categories of information, the sources of that information, the business purpose for collection, and the categories of third parties with whom we share it. You may also request a copy of the specific pieces of personal data we have about you.
  • Right to Delete: You have the right to request deletion of your personal information that we have collected from you and retained, subject to certain exceptions (for example, we may retain information needed to complete a transaction you requested, to detect fraud, to comply with legal obligations, or other exceptions provided by law). If you request deletion, we will also direct our service providers to delete your information from their records, where required.
  • Right to Correct: You have the right to request correction of inaccurate personal information maintained by us, taking into account the nature of the information and the purposes of processing. If any personal details you have provided to us are outdated or incorrect, you can request that we update them.
  • Right to Opt Out of “Sale” or Sharing: You have the right to opt out of the sale of your personal information. The CCPA defines “sale” broadly to include certain sharing of data for valuable consideration or for cross-context behavioral advertising. However, Thermo-Temp does not sell your personal information to third parties, and we do not share it for targeted advertising purposes.
  • Right to Opt Out of Targeted Advertising: Under the Texas law and some other state laws, you can opt out of processing of your data for targeted advertising (i.e. online advertising based on your browsing behavior across different websites/apps). As noted, we currently do not engage in such practices. If that changes, we will update this Policy and provide a method to opt out.
  • Right to Non-Discrimination: You have the right not to receive discriminatory treatment from us for exercising any of your privacy rights. This means we will not deny you services, charge you a different price, or provide a lesser quality of service just because you exercised your rights under CCPA, TDPSA, or any other privacy law. We may, however, offer certain financial incentives (such as discounts or rewards) that you can choose to opt into in exchange for certain personal information – but any such program will be fully disclosed and subject to your prior opt-in consent.

How to Exercise Your Rights: If you are a California, Texas, or other U.S. state resident and wish to exercise any of these rights, you may contact us using the information in the Contact Information section below. Please specify which right you intend to exercise and provide us enough information to verify your identity (for example, by providing at least two data points we have on file, or any identification information required by law). We will respond to your request within the timeframe required by law (generally within 45 days for CCPA, which may be extended by an additional 45 days with notice). If we need more information to verify or complete your request, we will let you know. In certain cases, we may decline or limit a request, for example if we cannot verify your identity or if an exemption applies – but we will explain the reason in our response. If we deny your request, you have the right to appeal our decision by contacting us and providing details of your concern; we will review and respond to any appeal as required by Texas law.

Rights for European Union/EEA Residents (GDPR)

If you are located in the European Union, United Kingdom, or another jurisdiction with similar laws, you are entitled to additional rights under the GDPR or applicable data protection legislation. These rights (often called “data subject rights”) include

  • Right to Access: You can ask us to confirm if we are processing your personal data and request a copy of the personal data we hold about you. We will provide you with a copy of your data, or let you know if we have none, subject to some exceptions (e.g., if providing a copy would adversely affect the rights of others).
  • Right to Rectification: If any of your personal data is inaccurate or incomplete, you have the right to request that we correct or update it without undue delay.
  • Right to Erasure: You have the right to request deletion of your personal data in certain circumstances – for example, if the data is no longer needed for the purposes for which it was collected, or if you withdraw consent and we have no other legal basis to continue processing. This is sometimes known as the “right to be forgotten.” We will honor valid erasure requests unless we are legally required or have compelling legitimate grounds to keep the data (in which case we will inform you).
  • Right to Restrict Processing: You can ask us to limit the processing of your data in certain situations – for instance, while we are verifying the accuracy of your data or if you object to our processing and we are considering that request. If you exercise this right, we will still store your data but not use it further until the restriction is lifted (unless for legal reasons).
  • Right to Object: You have the right to object to our processing of your personal data when that processing is based on legitimate interests (including profiling based on those interests) or performed for direct marketing purposes. If you object to direct marketing, we will stop sending you marketing communications. If you object on other grounds, we will evaluate whether our legitimate interests in processing your data outweigh your privacy rights; if they do not, we will cease the processing in question.
  • Right to Data Portability: Where we process your personal data based on your consent or on a contract with you, and the processing is carried out by automated means, you have the right to obtain a copy of your data in a common machine-readable format (and/or have it transmitted to another data controller where technically feasible). This right allows you to take your data to another service provider if you wish.
  • Right to Withdraw Consent: If we rely on your consent to process any of your personal data, you have the right to withdraw that consent at any time. For example, you can withdraw your consent to marketing emails or SMS and we will stop those communications going forward. (Note that withdrawing consent does not affect the lawfulness of any processing done before the withdrawal.)
  • Right to Lodge a Complaint: You have the right to file a complaint about our data practices with a supervisory data protection authority in your country. We would, however, appreciate the chance to address your concerns directly before you do so – please feel free to contact us with any issues and we will do our best to resolve them.

Exercising EU Rights: You may contact us at any time to exercise the above rights. We may need you to verify your identity before fulfilling your request (to ensure that we do not disclose your data to someone else). We will respond to requests within one month, or inform you if we need more time. For certain requests, we may have a legal basis to deny or refuse (for example, we cannot erase data that we are required to keep by law), but we will explain any such decision. There is no charge for exercising your rights, unless requests become excessive or manifestly unfounded, in which case a reasonable fee may apply as permitted by law.

International Data Transfer: Please be aware that when you provide information to us or use our services, your data will be processed in the United States where Thermo-Temp is based. The U.S. may not have the same level of data protection laws as in your home country. However, we will take appropriate measures to ensure that your personal data remains protected in accordance with GDPR standards. This may include using Standard Contractual Clauses approved by the European Commission or ensuring we work with U.S. service providers certified under frameworks like the EU-U.S. Data Privacy Framework (if applicable). By using our services, you understand that your personal information may be transferred to and stored on servers located in the United States. Data Security

We employ reasonable and appropriate security measures to protect your personal information from loss, misuse, and unauthorized access or disclosure.
